SWEEPSTAKES PERIOD: The Sync Up at Lollapalooza Text to Win Sweepstakes (“Sweepstakes”) starts on June 22^nd, 2009 at 12:00AM Central Daylight Time (“CDT”) and ends on July 17^th, 2009 at 11:59PM CDT (the "Sweepstakes Period").

TO ENTER: The Sweepstakes is only offered at participating retailers of Energy Brands Inc., d/b/a glacéau products in the states of IN, OH and KY. There are two ways to enter this Sweepstakes:

1. Text Message: During the Sweepstakes Period, send the keyword “SYNCUP” to 52257 from your 2-way text messaging capable wireless phone. Once you send the text message, you will be automatically entered into the Sweepstakes. All text message entries must be received by July 17^th, 2009 at 11:59PM CDT to be eligible for the drawing.

All entrants must have a two-way text messaging capable handset in order to enter the Sweepstakes using the text messaging method. Standard text message rates may apply. Text messaging and wireless service are not available in all areas.

2. Online: Entry is available online for free without sending a text message during the Sweepstakes Period at www.textrules.com/vitaminwatersyncup . Entrants will be asked to follow the instructions online and enter their first name, last name, address, city, state, ZIP code, age, phone number, email address and keyword in order to enter the sweepstakes. By submitting your contact phone number and/or email address, you grant permission to be contacted by Energy Brands Inc., d/b/a glacéau via phone and/or email. All web entries must be received by July 17^th, 2009 at 11:59PM CDT to be eligible for the drawing.

There are no limits for the number of entries per person.

ELIGIBILITY: The Sweepstakes is open only to all legal residents of the states of IN, OH and KY, who are 21 years of age or older at the time of entry. Void in all other states and where prohibited by law. Employees and directors of Energy Brands Inc., d/b/a glacéau (“Sponsor”) Vibes Media, LLC (“Administrator”), and each of their parent, subsidiary companies, affiliates, divisions, franchisees, representatives, consultants, sub-contractors, suppliers, distributors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, participating retailers and members of their immediate families (defined for these purposes as including spouse, parents, children, and siblings and each of their respective spouses) and individuals living in the same household, are not eligible to participate. By participating, entrants agree to these Official Rules and the decisions of Energy Brands Inc., d/b/a glacéau, which are final and binding in all matters relating to this Sweepstakes.

RANDOM DRAWING: A random drawing will be conducted on or about July 20, 2009 from all eligible entries received for the Sweepstakes. Drawing will be conducted by Vibes Media, LLC an independent marketing agency, whose decisions will be final in all matters relating to this Sweepstakes. Potential winner will be notified by text or phone call depending upon method of entry. If the selected potential winner cannot be contacted, he/she will be disqualified and an alternate winner will be chosen. Odds of winning will depend upon the total number of eligible entries received, regardless of method of entry.

PRIZE & APPROXIMATE RETAIL VALUE:One (1) Grand Prize – Prize consists of 2 tickets to the Lollapalooza Festival in Chicago, IL August 7-9, 2009, 3 nights hotel accommodations (one room, double occupancy), $700 in the form of a Travel voucher (includes money for transportation and other expenses). Travel to Chicago is not included. Approximate Retail Value (“ARV”) $2,250. Terms and conditions of Event tickets will apply in the event that the event does not occur due to weather, an act of God, threat or act of terrorism, civil disturbance or any other reason. Cash cannot be substituted for any ticket prize unless otherwise agreed by the Sponsor. Unused tickets cannot be refunded, exchanged or applied towards tickets for any subsequent years. No responsibility is assumed by Sponsor, for any cancelled, rescheduled, delayed or postponed events in whole or in part. If unused, event tickets cannot be returned, refunded or exchanged for cash value or substitute tickets. Lost, stolen, or damaged concert tickets will not be replaced or exchanged. Should a portion of the prize be canceled, postponed or in any way abbreviated after winner reserves travel plans to attend the Festival, the Sponsor shall have no liability or further obligation to the winner other than to supply the trip as described, with no further compensation being paid in exchange therefore. Prize consists of only the items specifically listed as the prize. Prize will be awarded “as is”.

Any difference between approximate value and actual value of the trip will not be awarded in cash. Winner is responsible for all other expenses and costs not expressly listed above, including but not limited to gratuities, meals, fuel, rental car, incidentals and optional entertainment. All federal, state and local laws and regulations apply. Potential winner is subject to verification of eligibility. Potential winner must sign and return an Affidavit of Eligibility/Release of Liability/Prize Acceptance and Travel Release Form within two (2) days of notification. If a potential winner does not respond within the designated time, or there is a return of any prize/prize notification as undeliverable, he/she will be disqualified and an alternate will be selected. Upon disqualification, no further compensation will be given.

RESTRICTIONS: Winner may make no substitution or transfer of prize and prize is not exchangeable for cash. All federal, state and local taxes are the sole responsibility of winner. If you send your entry via text message, prize will be awarded to the name corresponding to the phone number from which the text message originated. If you send your entry online, prize will be awarded to the name corresponding to the phone number and/or email address submitted on the entry. In the event of a dispute as to the identity of an entrant, entry will be declared made by the authorized account holder submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to a mobile telephone number (MTN)/email address by a telephone company, wireless service provider, Internet access provider, Internet service provider or other organization (e.g. business, educational, institution, etc.) that is responsible for assigning email addresses, telephone numbers or wireless phone numbers for the telephone exchange associated with the submitted telephone number/email address or the domain associated with the submitted telephone, as applicable.
